Proposal to develop casino at Lake of the Ozarks could go to Missouri voters next year

After years of failed legislative attempts to establish a casino at the Lake of the Ozarks, the Osage River Gaming and Convention group seeks to put the issue before Missouri voters in 2024.

The Missouri Secretary of State’s Office recently certified the ballot summary language for the group’s four initiative petitions, and Tim Hand, spokesman for the investor group, expects that signatures will soon be collected.

Although the group had four versions of the initiative petition approved, they ultimately decided on the version that earmarks the tax revenue derived for public pre-kindergarten education programs.

Hand has been involved in efforts to establish a casino at the lake for more than 10 years.

Only 13 gambling licenses are available for casinos in Missouri, and these structures must be on an excursion gambling boat, although this could be a non-floating structure within 1,000 feet of the Missouri or Mississippi River.

The initiative petition seeks to establish a 14th gambling license for a structure built near the Osage River. If approved, the casino would be located on a section of the Osage River below the Bagnell Dam.

The casino would be operated by an an existing commercial gaming entity. Polling by Show Me Victories indicates that 77% of those polled would support a casino if the tax revenue went to such pre-kindergarten education programs and early childhood literacy programs. Polling by other entities produced very similar results.

Annual revenue for a casino at the lake is projected to be anywhere from $100 million to $150 million . If the casino brings in $100 million annually, the state would stand to receive $22.8 million and the City of Lake Ozark and Miller County would get just over $4 million a year.

The Osage River Gaming group's plan isn't the only potential casino development in the works.

The Osage Nation tribe is also seeking to build a casino at Lake of the Ozarks, which does not require a new gambling license from the state, but rather state and federal approval. A tribal casino would generate no state or local tax revenue.

As a Native American tribe, it is allowed to operate gambling facilities, with approval, on any land that is placed in a trust for the tribe. Once placed in a trust, the land becomes a sovereign nation, which technically is not part of the United States.

The Osage Nation did not respond to requests for comment, so it is unclear what the status of their project is at this time. In March, the group had cleared land for its project and was “ well into its petition with the federal government to open one .” 

Failed legislative efforts led organizers to launch initiative petition

In 2009, a fire destroyed the gambling riverboat President, opening up a gambling license to a new establishment in the state. The evaluation of proposed sites revealed that the license was issued based on where it would least cannabalize existing gambling operations, generate the most new net revenue and have strong local support.

That license was granted to build a casino in Cape Girardeau, but Hand and other investors saw it as an opportunity to consider constructing a casino at the lake, if the state would issue another gambling license.

“Some of my business partners that own retail businesses at the lake tell me that 75% of their credit card receipts are from out of state in the summer, which you can imagine,” Hand said. “So we thought based on those criteria, this place would be a shoe-in.”

An investor group was formed with a long-term timeframe in mind when approaching this issue, as the regulatory hurdles of obtaining the gambling license would take some time to clear. 

By 2018, the group had a plan to move forward with an initiative petition, but former state Rep. Rocky Miller suggested that the issue be presented as legislation first, which is much less costly than gathering signatures for an initiative petition. 

However, the onset of the COVID-19 pandemic put a damper on those plans, as the legislation would have been heard in 2020 by the Missouri General Assembly. The pandemic was a hard time for casinos, most of which were shuttered for long periods of time, and Osage River Gaming and Convention decided to wait for a more opportune time to proceed with their plans.

“It was a scary time for gaming. The industry got hit really hard,” Hand said, “We just decided to sit on the sidelines for the time being and see how this all plays out.”

In 2022, the group launched a new effort in the legislature to approve the new gambling license, but was blocked by heavy opposition from the Osage Nation tribe. A final attempt to pass the measure via the legislature was underway in the 2023 legislative session, but a filibuster stymied passage of the bill.

Investors of Osage River Gaming and Convention decided that proceeding with the ballot initiative was the best way forward, though no time was truly lost in their most recent efforts.

“It has to go on the ballot for a presidential election year. The good news is that even in the past few legislative sessions, it would have had to wait till 2024 anyway to be on the ballot,” Hand said. “So we really didn't lose any time. Ultimately we just gained a lot of aggravation.”

The group has quietly been preparing to launch its ballot initiatives, waiting until certification of ballot language from the Missouri Secretary of State to play their cards.

“It isn't like we just popped up out of nowhere. This is a group of very substantial lake investors who've been working at winning this for a long time. We’ve spent a lot of time dotting our i’s, even before with the legislative route. We did a ton of research and made plans to fund the effort,” Hand said. “I keep hearing, ‘We are so surprised you're this far along,’ so I guess we did good on keeping it quiet.”

Now, the race is on to collect more than 171,000 signatures before the first week of May, which is the deadline to submit enough valid signatures to make the 2024 ballot. However, given their preparation and planned strategy, Hand feels confident that the group will meet their goal.

“Signature collection is both an art and a science. It's one of the reasons we hired a firm to do it,” Hand said. “They will be opening up several offices in various parts of the state to start the signature collection process, all before the end of the year.”
