Motor Yacht

Feadship Faith (ex. Vertigo) saw the light of day on Wednesday 23 November, which is when this 96.55-metre masterpiece left the construction hall at the Feadship yard in Makkum (NL).

With the outstanding interior and exterior design by Redman Whiteley Dixon and Chahan Interior Design and Azure acting as Owner’s project manager, Faith’s creative execution raises the bar of superyacht design to new levels of sophistication.

The elegant curves of Faith's streamlined profile are in perfect proportion and harmony. The same applies to the characteristically Feadship lines of Faith's flared bow, which features a games deck and helicopter landing pad with a hangar below for a Bell 429 WLG helicopter.

The sweeping hull line leads down and aft towards the main deck aft, home to a revolutionary swimming pool made of glass panels that also form the ceiling of the beach club below. Creating this 68-millimetre-thick construction involved laminating together five layers of clear glass interspersed with foil. To make matters even more complex, the deep end of the 42,000-litre pool has a dramatic S-curved shape and descends to some 2.5 metres. A drop-down cap rail allows an open view to the sea from inside the pool and a curtain of water to flow into the forward section of the pool and fashion a natural divide between this exterior area and the interior.

A top New York City lawyer and his jewelry designer wife are among the six still unaccounted for after the Bayesian superyacht capsized off the coast of Sicily on Monday morning.

Of the 22 people aboard the 184-foot luxury British vessel , the Bayesian, fifteen were rescued after it overturned amid bad weather conditions - one body was found, and lawyer Christopher Morvillo and his wife Neda Morvillo are among the six passengers still unaccounted for.

The Italian coast guard said the sailboat overturned sometime after 5 a.m. off the port of Porticello, near Palermo, where it was anchored. Ten crew members and 12 passengers, including British, American and Canadian nationalities were onboard.

Before becoming a partner at prestigious law firm Clifford Chance in New York City, 59-year-old Fordham graduate Morvillo was a former federal prosecutor who worked on the investigation of the terror attacks on September 11, 2001, according to his online bio. Currently, he specializes in cases involving insider trading and corporate fraud.

Morvillo most recently represented British tech tycoon billionaire Mike Lynch, the owner of the capsized Bayesian who is still missing along with his 18-year-old daughter Hannah, in a fraud trial. Lynch was accused of fraud related to Hewlett Packard's acquisition of his company, Autonomy.

Morvillo, who owns residences in New York City and South Kent, celebrated Lynch's June 6 acquittal on LinkedIn in one of his final social media posts before the luxury boat accident, eerily writing that his family would live "happily ever after."

"A huge thank you to my patient and incredible wife, Neda Morvillo, and my two strong, brilliant and beautiful daughters, Sabrino Morvillo and Sophia Morvillo," he wrote after thanking the legal team that helped in Lynch's legal success.

Criminal defense lawyer and podcast host David Oscar Markus interviewed Morvillo last week, describing him as a "superstar lawyer" in a blog post.

"Chris dedicated over a decade of his career to obtaining justice for Mike Lynch," Markus wrote. "He got it and then for this to happen.... it's tough to find the right words."

Lynch's acquittal "end[ed] a 13-year legal battle, regarded as one of Silicon Valley's biggest-ever fraud cases," Clifford Chance wrote in a press release.

"The verdict closes the book on a relentless 13-year effort to pin HP's well-documented ineptitude on Dr. Lynch," the firm wrote. "Thankfully, the truth has finally prevailed. We thank Dr. Lynch for his trust throughout this ordeal and hope that he can now return home to England to resume his life and continue innovating."

At the end of the statement, Lynch hauntingly said that he was "looking forward to returning to the UK and getting back to what I love most: my family and innovating in my field."

Inside the Maldives’ first superyacht marina, the newest playground of the super rich

Y ou’d be forgiven for assuming the Maldives, a country that is 99 per cent water and a playground for the uber wealthy, comfortably caters for the yachting elite. The archipelago’s 172 luxury resorts, many of which are built on private islands, offer every conceivable amenity, from sublime underwater spas to incongruous snow rooms. Yet a purpose-built superyacht marina is a glaring omission from the list, an anomaly that Atoll Estates is looking to change.

The UAE-based company has revealed plans for a five-star development set within 500 hectares of a natural lagoon in the South Malé Atoll. Located just 21 miles from Malé International airport (which completes a large expansion in 2025 to cater for the estimated 4.3 million travellers passing through each year), Zamani Islands will comprise three individual resorts spread across eight islands. Designed in partnership with Dubai-based architects Killa Design, it promises to host the island chain’s first dedicated superyacht marina.

“By providing state-of-the-art facilities for superyachts , the marina will attract more high-net-worth individuals and yachting enthusiasts to the region,” says Amit Majumder, co-founder and managing partner of Atoll Estates, who believes the influx will boost local tourism. “The increased yachting traffic will foster the development of related services and infrastructure, further establishing the Maldives as a premier yachting destination on the global stage.”

The initial phase of the development, set to open in 2026, will include the first of three distinct resorts made up of a collection of private residences, each with a private pier for yacht tenders. Lifelong berthing at the marina (once complete) will also be included. The second “multi-experiential” resort is aimed at families and couples with a private island beach club for over 21s, while the third “lifestyle” resort will have a total of 300 keys, a yacht and sailing club and the largest events and entertainment venue in the country.

Spanning a whopping 60,000 square metres, Zamani Islands marina’s full-service facilities are pitched to include crew amenities, provisioning, maintenance and access to a yacht club. Of the 120 yacht berths, 60 will be dedicated to superyachts upwards of 30m in length, with a single dockside mooring of up to 200m. Other resort amenities include the first medical spa in the country (though Soneva’s two wellness complexes may have pipped them to the post), personal butler service, and 28 food and beverage venues, including an underwater restaurant.

It’s no secret that the Maldives’ wide-open waters, vibrant coral reefs and diving hot spots make it a yachting haven. Around 70 to 100 large motor and sailing yachts arrive in Maldivian waters each year (per 2021-2023 Maldivian Coast Guard cruising permit applications). The country’s strategic location in the Indian Ocean also makes it a convenient stopover for yachts travelling between the Middle East, southeast Asia, and the Indian subcontinent. According to tracking data compiled by Bloomberg, the Maldives saw more visiting yachts than Hong Kong and Singapore combined in 2023, slightly outpacing Thailand. So why has there not been a superyacht marina in the pipeline before now?

“For the past 20 years, the Maldives’ private resort tourism model has proven highly profitable and pretty low risk,” says Splinter Fangman, a yacht and berth broker at Edmiston. “With a superyacht marina, it’s still a gamble whether the yachts will actually use it.”

For vessels upwards of 70m that can sustain themselves at anchor for weeks at a time, the Maldives’ current lack of infrastructure isn’t an issue. Yachts like 134m Serene and 97m Faith are self-sufficient floating resorts equipped with their own high-end amenities, even the aforementioned snow room. Provisioning and fuel bunkering is done ship to ship using a large barge that caters for private island resorts. Though the opportunity to dock at a marina to use shore power, turn off systems and generators, and allow the crew to go ashore is appealing, it’s not a requisite, says Fangman, especially for owners who prize privacy above all else.

For smaller yachts that depend on the services of a marina, making the crossing to the Indian Ocean can be challenging. That said, the Maldives is well placed to capture substantial traffic in the burgeoning Asia-Pacific yachts, while vessels based in the Middle East regard it as an attractive alternative to the crowded anchorages of the Caribbean.

“A marina in the Maldives will pull through huge numbers of yachts from the Red Sea and Persian Gulf,” says Donovan Chong, an independent marina entrepreneur. He cites the 146m Lürssen-built Opera, owned by Sheikh Abdullah bin Zayed bin Sultan Al Nahyan, the deputy prime minister of the United Arab Emirates, which typically berths in Dubai, as a frequent visitor to the Maldivian archipelago.

Demand for a marina that caters to the super rich is now a strategic focus for the Maldives, adds Chong, who notes there are several additional imminent marina projects in the pipeline. “The Maldivian government has made it a top priority to explore new tourism verticals beyond hotels and resorts and to establish the Maldives as the ‘eastern terminus’ of the yachting world.”

He believes a dedicated marina will unlock the untapped potential of the Maldives as a charter (yacht rental) hot spot, and that future resorts need to be built around the marina, rather than treating it as an amenity. Majumder agrees. “Zamani Islands is more than just a residence; it is a lifestyle — one that seamlessly blends the opulence of land and sea, providing a haven for those who appreciate the finer things in life.” In other words, build it and the yachts will come.

12-minute search shifts resume for 6 from sunken yacht off Sicily, including tech giant Mike Lynch

by ANDREA ROSA and NICOLE WINFIELD / Associated Press

Emergency services at the scene of the search for a missing boat, in Porticello, southern Italy, Tuesday, Aug. 20, 2024. Rescue teams and divers returned to the site of a storm-sunken superyacht Tuesday to search for six people, including British tech magnate Mike Lynch, who are believed to be still trapped in the hull 50 meters (164-feet) underwater. (AP Photo/Salvatore Cavalli)

PORTICELLO, Sicily (AP) — Police divers resumed searching Tuesday for six people, including British tech magnate Mike Lynch, believed trapped some 50 meters (164 feet) underwater in the hull of a superyacht that sank in a storm off Sicily.

Divers in wetsuits and oxygen tanks returned to the site off Porticello, near Palermo, to tag-team in 12-minute underwater search shifts where the luxury sailboat went down. Fire rescue crews reported that divers only made it to the bridge during a first search, and were unable to access the below-deck cabins because they were blocked by furniture that had shifted during the violent storm that toppled the vessel early Monday.

Fifteen people survived, including a mother who reported holding her 1-year-old baby over the waves to save her. One body has been recovered, identified as the on-board chef, officials said.

The Bayesian, a 56-meter (184-foot) British-flagged luxury yacht, had been moored about a half-mile off Ponticello when a storm rolled in around 4 a.m. Monday. Civil protection officials said they believed the ship was struck by a tornado over the water, known as a waterspout, which had passed through the area.

The search for the six missing passengers has been slow because the Bayesian is resting at a depth of 50 meters, where divers can stay for only 12-minute shifts, the fire rescue team said in a statement Tuesday.

The rotating search teams, each made up of two specialized cave divers, were working Tuesday to open up other access points to get inside of the wreckage. Rescue crews said they assume the six passengers will be found in the below-deck cabins, given the time of the shipwreck, but that they have not managed to verify their presence there through portholes.

The statement referred to the six as “missing.” Fire rescue officials have said the six will be considered missing until they are located in the wreckage.

Fifteen of the Bayesian’s 22 passengers and crew managed to escape on a lifeboat before being rescued by a nearby sailboat that was also moored offshore to ride out the storm, Karsten Borner, the sailboat's captain, told reporters at the scene.

Among those missing was Lynch, who was once hailed as Britain’s king of technology. He was cleared in June of fraud and conspiracy charges in a U.S. federal trial related to Hewlett Packard’s $11 billion takeover of his company, Autonomy Corp. His wife, Angela Bacares, survived.

The sailing vacation appeared to be something of a celebration after Lynch's acquittal, since fellow passengers included some of the people who had stood by Lynch throughout the ordeal. Among those unaccounted for, according to the civil protection agency, were one of Lynch’s U.S. lawyers, Christopher Morvillo of Clifford Chance, and Morvillo’s wife.

Also missing was Jonathan Bloomer, a chairman at Morgan Stanley International and the former head of the Autonomy audit committee who testified at Lynch’s trial for the defense, and his wife. Lynch appointed Bloomer to Autonomy’s board of directors in 2010, where he served as chairman of the audit committee at the time of the HP deal.

International insurance company Hiscox Group, where Bloomer was chairman, was "deeply shocked and saddened by this tragic event," Hiscox Group CEO Aki Hussain said in a statement. "Our thoughts are with all those affected, in particular our Chair, Jonathan Bloomer, and his wife Judy, who are among the missing, and with their family as they await further news from this terrible situation.”

Among the survivors was Charlotte Golunski, who said she momentarily lost hold of her 1-year-old daughter Sofia in the water, but then managed to hold her up over the waves until a lifeboat inflated and they were both pulled to safety, Italian news agency ANSA reported. The father, identified by ANSA as James Emslie, also survived.

The yacht, built in 2008 by the Italian firm Perini Navi, was carrying 12 passengers and 10 crew. According to online charter companies, it has been available for charter for 195,000 euros (about $215,000) a week and is notable for its massive 75-meter tall aluminum mast, one of the tallest in the world.

Winfield reported from Rome. AP reporters Danica Kirka and Kelvin Chan contributed from London.

Mike Lynch, recently acquitted in HP-Autonomy fraud case, is missing after yacht capsized off Sicily (updated)

faith superyacht

Update : Authorities have yet to access the inside of the sunken yacht, and Mike Lynch is still classified as missing. Other details have emerged in the interim.

The accident appears to have been caused by a major storm and a resulting tornado-like water column that ensnared and damaged the yacht. Among the other six people still missing are Lynch’s 18-year-old daughter and Morgan Stanley International chairman Jonathan Bloomer. The voyage was to celebrate Lynch being acquitted of criminal charges in the U.S., and several members of his legal team were also on board. (The ship was registered to Lynch’s wife, one of the survivors.) By a terrible coincidence, the other person acquitted in Lynch’s trial — Autonomy’s finance head Stephen Chamberlain — had died just a few days before when he was hit by a car while out jogging. Original article continues below.

Mike Lynch, the investor and high-profile founder of U.K. tech firm Autonomy, has been declared missing at sea after the yacht he was on, the Bayesian , capsized in a storm off the coast of Sicily early Monday morning.

TechCrunch confirmed with a source close to the rescue operation that Lynch is one of six people missing from the boat. Lynch’s wife, Angela Bacares, is one of the 15 who have been rescued. One body has been found.

The news is a dramatic, tragic development for one of the more colorful, and sometimes controversial, figures in technology out of the U.K.

Lynch’s enterprise technology firm Autonomy was acquired in 2011 by HP for $11 billion — a major milestone for U.K. technology. But it quickly turned sour, and HP sued Lynch and other executives at the company, arguing it was misled in the transaction.

HP claimed that the deal led to a $4 billion loss — money it then demanded from Lynch and his former CFO. Lynch (pictured above, left) long asserted that he acted in good faith and that he was being made into a scapegoat over a merger gone bad.

That legal drama went on for more than a decade and involved a host of other thorny chapters, including Lynch’s extradition to the U.S. and a lot of very bad publicity for Lynch. It also led to a second civil case that took place in 2022 in the U.K., which Lynch lost.

The U.S. criminal case, where Lynch was charged with 15 counts of fraud and conspiracy, went to trial earlier this year in San Francisco. Finally, in June, Lynch was acquitted .

“I am elated with today’s verdict and grateful to the jury for their attention to the facts over the last ten weeks. My deepest thanks go to my legal team for their tireless work on my behalf,” Lynch said at the time. “I am looking forward to returning to the UK and getting back to what I love most: my family and innovating in my field.”

In the interim years, Lynch built up a profile in the U.K. as an investor, most prominently as the founder of Invoke Capital . The VC firm was the biggest investor in cybersecurity firm Darktrace, a connection that was not without its own controversy . It also invested in Sophia Genetics , Featurespace and Luminance, among others. And it appeared that this is the route that he was set to continue.

Our thoughts go out to his family, friends and colleagues. We’ll update this post as we learn more.

Virginia’s New Bad Faith Law: What Insurers Need to Know

On July 1, 2024, new Virginia Code § 8.01-66.1 became effective and created a new bad faith cause of action that can be significant for underinsured or uninsured (UIM) carriers.

The prior Va. Code § 8.01-66.1 did not create a duty for UIM carriers to settle a case prior to trial. Instead, it only created a remedy when UIM carriers refused in bad faith to pay once the insured had obtained judgment. Manu v. GEICO Cas. Co. , 293 Va. 371, 391 (2017).

But pursuant to the new Virginia Code § 8.01-66.1, the UIM carrier’s duty is no longer triggered by a judgment; instead, it is triggered “when liability to the [] insured has become reasonably foreseeable without necessity of a judgment by its insured . . .”

Once this duty is triggered, a UIM carrier can now be liable if it, in bad faith:

  • denies, refuses, fails to pay, or fails to make a timely and reasonable settlement offer or
  • after all applicable liability policy limits and underlying UIM benefits have been tendered or paid, rejects a reasonable settlement demand within the UIM policy’s coverage limits or fails to respond within a reasonable time after being presented with such demand.

If a court determines that a UIM carrier’s conduct was not in good faith, then it shall award not only the amount due and owing by the UIM carrier to its insured, but also an amount up to double the judgment obtained against the tortfeasor, not to exceed $500,000, along with attorney fees for bringing the bad faith claim, and all costs and expenses incurred by the insured to secure a judgment against the tortfeasor, and interest.

The new Virginia Code § 8.01-66.1 marks a significant shift in the legal landscape for UIM carriers in Virginia. As a result of this new bad faith law, UIM carriers need to be diligent and cautious in handling the early resolution of UIM claims to mitigate risk. And given the tight timelines in the statute for investigating liability and damages and responding to demands, UIM carriers should consider early engagement with legal counsel to ensure a timely and appropriate response.
