Man who grounded yacht in Palm Beach served time for Ferrari theft

The owner of a  72-foot-yacht beached early Wednesday in the North End of Palm Beach has a penchant for expensive toys.

But a review of court documents reveals Thomas Henry Baker hasn’t always paid for them.

>  PHOTOS: 72-foot yacht washes ashore in Palm Beach

In June 2009, Baker, pleaded guilty to knowingly selling two stolen high-end sports cars the previous year — a 1985 Ferrari Testarossa valued at $55,000 and  a 1996 Ferrari F50  with a market value of $729,000. The F50 theft was national news because an FBI agent crashed the car after it was recovered.

Baker, 63, of Belle Isle, south of Orlando, made news again last week when he was charged with boating under the influence. Palm Beach police said a trip with his girlfriend from the Bahamas ended when his $500,000 yacht, the Time Out, ran aground just south of the Palm Beach Inlet.  The yacht   remained there early Saturday evening.

It was Baker’s third alcohol-related arrest in just over two years and his second boating under the influence charge in the past month, records show.

As part of a plea deal in 2009 in U.S. District Court, Baker admitted he stole the Testarossa on July 15, 2003, from Gullwing MotorCars in Long, Island, N.Y., and stole the Ferrari F50 on Sept. 16 of that year from Algar Ferrari of Bryn Mawr, Penn.

Baker was living in Nicholasville, Ky., at the time. He admitted to hiding the cars he stole in storage units, altering their vehicle registration numbers and fraudulently acquiring titles for them. According to one victim, Baker hid the purloined Ferraris in a hangar at the Lexington Airport.

In September 2009, the U.S. District Court, Eastern District of Kentucky, ordered Baker to reimburse his victims and pay a $250,000 fine and sentenced him to six months in prison for one felony count of sale or receipt of stolen vehicles.

Revelation ‘left me stunned’

According to the U.S. District Court records, in 2008, Dr. Jasbir Dhillon, a general surgeon, paid Baker $375,000 and gave him about $100,000 worth of “rare and exotic firearms” for the Ferrari F50. It was one of only 349 built, according to Sotheby’s.

Dhillon was working at a Kentucky hospital when a colleague of his wife’s introduced him to Baker.

In a Feb. 25, 2011, post to an online forum for car collectors, Dhillon described how he felt in 2008 when he learned that the Ferrari that Baker sold him was stolen and would be seized by the FBI.

“I cannot tell you how that moment felt … utter disbelief, shock … a knee-bending moment that left me stunned. I knew I had let my guard down and done a deal in a way that I never had before. And it stood to cost me several hundred thousand dollars,” Dhillon wrote.

Dhillon, however, managed to get a full refund before the FBI arrested Baker and seized the car.

“I could never imagined this fellow being capable of that … something so brazen. I just didn’t see it in him. But I suppose the desire to be something you are not just overwhelmed him,” Dhillon wrote.

While Dhillon got his money back, the F50 suffered a less fortunate end.

In May 2009, while reportedly moving the car from one storage site to another, an FBI agent lost control of the car and crashed it into a tree. The F50 was totaled.

In May 2008, Baker gave Karol Poulos the Testarossa to settle a $20,000 debt, records show. Later that month, she accepted a $2,000 deposit from a man to buy it. Federal agents ordered her to return it. Poulos is listed as a friend in the 2009 plea agreement but during Baker’s arrest in Palm Beach on Wednesday, Poulos told police she is Baker’s girlfriend.

More charges

In May 2014, Baker was arrested in Orange County on charges of driving under the influence and damaging property, records show. He later pleaded no contest to reckless driving.

Baker also was charged with boating under the influence on Aug. 14 in Brevard County, court records show. His arraignment in that case is scheduled for Sept. 19. According to records, Baker was charged after officers noticed a 70-foot yacht “operating carelessly” in Port Canaveral. Tests showed a blood alcohol content of 0.206, records show. The legal limit in Florida is 0.08. He also was cited for having an expired vessel registration.

Baker told Palm Beach police Wednesday that “his GPS misguided him to shallow waters near the coastline,” causing his yacht to run aground. Baker also said he had  “several Long Island Iced Teas” in the hours before Time Out hit shore around 2:15 a.m. Wednesday.

Career questions

On the Palm Beach police report about Baker’s arrest Wednesday, Baker is listed as a retired federal air marshal. A Transportation Security Administration spokesman said agency records show no one matching Baker’s name and age has been an air marshal.

The TSA, however, did certify Baker as a federal flight deck officer in June 2007. That allowed Baker to carry a gun while piloting flights. The privilege was revoked in 2009 because of the thefts.

Baker’s Facebook page says he’s a former JetBlue pilot.

During his sentence in Kentucky, Baker was in custody from Monday mornings to Thursday mornings, but allowed to be released to work his scheduled flight from Lexington to Orlando, court records show. The custody deal was then amended in October 2009 to Mondays through Wednesdays at Baker’s request to accommodate the flight schedule. The change added two months to his sentence, according to records.

In recent years, Baker has chartered small groups to the Caribbean on the Time Out through his company, Blue Waters Enterprise.

Thomas Baker: Captain who admitted drinking Long Island Ice Teas before grounding yacht gets deal

tommy baker yacht

Thomas Baker, the captain of an overturned 72-foot yacht who admitted to drinking Long Island Ice Teas last year, reached a plea deal in his case.

Baker pleaded guilty Friday to recklessly operating a vessel and will no longer be prosecuted for boating under the influence.

Baker, 63, of Belle Isle, Fla., a suburb of Orlando, told police he "failed to navigate his vessel into the Palm Beach Inlet and ran the vessel into the beach."

Palm Beach Police accused Baker of driving the yacht, "Time Out," onto the shoreline after claiming he had too many Long Island Iced Teas on September 7, 2016.

As part of the plea deal, Baker must complete DUI school and 75 hours of community service. He will be on probation for one year.

His case for leaving a derelict vessel on state waters remains open. In October, Baker sued the Town of Palm Beach for $450,000 to recover his losses.

Business, Baker Motor Company

tommy baker yacht

Take a look at a year’s worth of area charitable event banners and T-shirts, and the Baker Motor Company (BMC) crest is nearly ubiquitous among the lineup of sponsor logos. But if you ask the company’s founder and CEO, Tommy Baker, which of these causes is his favorite, he laughs off the question. “If I were to name any one,” Baker says, “I’d get 20 calls from the ones I didn’t name.”

Still, there are a few causes that particularly “pull at his heartstrings,” Baker admits—mostly those involving defenseless children (like anything related to MUSC Children’s Hospital) or students (especially motivated, business-minded kids). The fact that Baker identifies with bootstrap ambition makes sense. A self-made success story, he grew up as a lower-middle-class kid in Mount Pleasant and paid his way through The Citadel by teaching GED classes, selling cars, and eventually buying and selling property on the Isle of Palms. In 1988, after leaving the Palmetto State to learn the car business top to bottom, he returned to open the first of his many high-end dealerships, while at the same time attending Harvard Business School’s management program.

That the lifelong entrepreneur cites YESCarolina—in which kids across the state create, pitch, and often launch viable businesses—as a favorite philanthropy is no surprise. “Any one of those kids could have been me,” Baker says, “any one of them. So I’ve been on the board chairing since its inception. It’s such a privilege to watch these children, most from the inner city or those who’ve not had educational opportunities, learn entrepreneurship and how to turn their lives around with business skills. It’s phenomenal.” He relates those teens’ experiences to those of the students he has taught at the College of Charleston for more than two decades. As an “entrepreneur-in-residence” in the School of Business, he’s helped scores of budding business folk find their way. “But if it’s between calling me a teacher and a mentor,” he says, “I prefer ‘mentor.’ The hope is that you’ve given them enough tools so they can go out there and play the game—and play it the right way.”

CofC graduate Stewart Vernon, founder and CEO of America’s Swimming Pool Company, says Baker did exactly that for him. “The business lessons he taught helped mold me into the business person I am today.”

This year, along the lines of charity beginning at home, BMC started the “Tommy B. Baker Scholarship Fund,” which awards the spouse or child of a company employee $2,500 to put toward education. Shavonna Simmons, a mother of four whose husband works for BMC, is one of two 2013 recipients and will use the money to help fund nursing school. “He has offered to help me any way he could,” Simmons says, “so I can complete my degree. I’d often wondered where the kind-hearted people of the world are, but that question has now been answered.”

CHARITY DRIVE

Cruising Speed: Baker named his yacht, Lady Victoria, after his wife of 31 years, Vickie. They often offer up a cruise as a prize for fundraisers that BMC sponsors, such as the 2013 YESCarolina gala. Sounding Board: Before he found success with Butcher & Bee, Michael Shemtov was a young grad of CofC and former student of Tommy Baker looking to open Mellow Mushroom on King Street. “It was Tommy that I went to when I had an important meeting with the landlord,” he says. While running his dealerships, Baker’s calendar is still filled with weekly meetings with past students and other mentees.

Pilot's alleged 'drunken joy ride' under investigation

by Lynda Figueredo

62-year-old Thomas Baker will have to foot the bill and faces a second boating under the influence charge, there is no guarantee the commercial pilot has to report the charge to the FAA.

PALM BEACH (CBS12) — It's a crash that has caused quite a mess.

For nearly 3 days crews have been trying to find the safest way to move a 72-foot yacht off the beach.

While the man responsible 62-year-old Thomas Baker will have to foot the bill and faces a second boating under the influence charge, there is no guarantee the commercial pilot has to report the charge to the FAA.

"BUI has historically been treated differently than duo and boating under the influence is just as dangerous as driving under the influence and he is a classic repeat offender," said Attorney Gary Lesser. "That is a disaster."

For Lesser it serves as a reminder as to why boating under the influence should be taken more seriously.

"If you get a BUI theoretically things are supposed to happen. You aren't supposed to be behind the boat of another vessel and there he was. He showed total disregard for boating and getting behind a vessel," said Lesser.

Last year the state of Florida tried to pass a bill that would link driving and boating under the influence. That bill failed.

Being that Baker is a commercial pilot and was recognized in 2013 by the FAA as a prestigious FAA Airman you would think he would have to report this BUI to the agency. CBS 12 learned there is no federal requirement for him to do so.

"Data banks don't talk to each other," said Lesser. " Law enforcement agencies don't talk to each other. Any crimes involving drugs or alcohol should be reported to a regulatory agency like the fact so that person never gets behind flying a plane for our family or our friends."

In fact, Baker was charged with stealing a rare Ferrari in 2009. As part of his sentencing he was still able to fly commercially while serving federal prison time

Baker's next court date is set for October 6th. We learned he no longer works for JetBlue.

The circumstances surrounding his departure remain unclear.

As for the yacht, it will be some time before this boat sets sail again.

The hunt for Tommy Baker: on the trail of Papua New Guinea’s most-wanted man

PORT MORESBY, 06 SEPTEMBER 2021 (THE GUARDIAN) —-As the sun set over the coast of Alotau, a town in the east of Papua New Guinea, on a Friday night in April, four boats zoomed from the beach into the night. Onboard the dinghies there were close to 100 men, fully armed with high-powered firearms, including the country’s most-wanted fugitive: Tommy Baker.

Baker, who is wanted by police for alleged crimes including murder, piracy and robbery, has been on the run from police since 2013. He has twice escaped jail – one time by faking a knee injury and fleeing while he was being taken for medical treatment.

Police pursued Baker and the men to the coast, but by the time they arrived, the gang were long gone.

In April, the days leading up to Baker and his gang’s flight from the coast saw Alotau, the once-peaceful capital of Milne Bay province, in the country’s east, reduced to a war zone – the police barracks were burnt down (something Baker says he and his gang were not responsible for), shops looted, and a gun battle between Baker’s men and police lasted more than seven hours.

Locals from the area who wished to remain anonymous say they watched helplessly as the violence erupted and as the gang left, but claim they are suffering as they are caught in the middle between the police – with scores of officers being brought into Alotau to deal with the aftermath of the violence – and the gang.

“We just watched them leave – there were about nearly 100 of them or more, some came over the mountain from Alotau, others came in trucks with and some were waiting with the dinghies,” one said. “They were armed with guns but now we are being threatened by police… we live in fear, watching the roads. Who will we call for help?”

‘We do not choose our relatives’

The hunt for Tommy Baker has left a trail of destruction across the province of Milne Bay including shootouts with police, officers killed and homes burnt down, but also claims by locals of heavy-handed policing that has allegedly seen innocent people, who claim no affiliation with Baker, turned out of their homes, arrested, beaten and, in one case, killed.

Police say they are not aware of any mistreatment of civilians by officers and the claims are not supported by credible evidence.

In early August, police raided a village in Cape Vogel after receiving information that the village was allegedly harbouring Baker’s right-hand man, Michael “Mekere” Yawi, and other members of his gang. Locals claim around 20 homes were burnt down during the raid.

A villager who did not want to be named said his home and all his belongings were lost in the flames. “We are not criminals and we are not hiding them – our crime is been related to them. We cannot be blamed, we do not choose who our relatives are.”

Police confirmed the raid took place but say that just six homes, which they claim were used by the gang, were burnt down.

With a blanket of silence covering the province, many are afraid to talk and do not know who to trust.

A woman in Alotau, who also did not wish to be named, said she was afraid of both police and the gang members. “Who will protect us? Police they blame us, they beat our young men while the gang threatens us. We are afraid to speak,” she said. “Who do we go to, who do we trust? So we stay silent, praying for our families, praying for our Alotau.”

Violence, fear and escapes

Tommy Maeva Baker, 35, was born in Rabaraba, a village in Milne Bay. His name first started to appear in news reports in 2013, when he and his gang of close to 200 men started conducting armed robberies in Alotau. His crimes have resulted in a slew of deaths of people – police and villagers alike – across Milne Bay province and Papua New Guinea’s former prime minister Peter O’Neill labelled him a terrorist.

Baker has sometimes been painted as a folk hero – “Papua New Guinea’s Ned Kelly” – amid claims he is a man of people, standing up against “white men-colonisers” who “prosper and build their business empire using our land”, according to an interview he gave the Post Courier earlier this year. But David Manning, Papua New Guinea’s commissioner of police, has warned against Baker being glamorised in the media.

“This fellow is no Robin Hood, and is a violent thug who has brought death and misery to peace-loving people around Milne Bay,” Manning said.

The first report of his crimes was in 2013 when Baker’s gang allegedly broke into the Alotau Enterprise shop. A probationary police constable, a security guard and a female staff member were killed during the armed robbery.

The story of Baker’s alleged crimes involves a tit-for-tat relationship with police, with Baker responding to police incidents, and police responding to Baker’s alleged crimes, in an escalating cycle.

In 2016, after another of Baker’s right-hand men, Whitey, was shot and killed by police in Lae, police say Baker’s gang attacked police in Alotau, killing another police officer during the shootout. In 2018, Baker and eight members of his gang were arrested in Central Province and detained but he escaped from custody at the Port Moresby general hospital after faking a knee injury.

In January 2019, Baker and his gang allegedly engaged in a gun battle with police, killing a legal officer in the crossfire. They also allegedly burnt down eight police houses and a police vehicle, killing the wife of a police officer and her four-year-old son, who had locked themselves in a bathroom in the barracks. Their bodies were found in the ashes.

‘This requires a heavy hand’

After the gun battle in April this year, which ended with Baker and his men departing Alotau in their dinghies, there have been deaths – including of Baker’s right-hand man Mekere in a shootout with police – and arrests.

In late July, locals claim a young man suspected of being involved with Baker was arrested and beaten by police in front of villagers. He later died in the Alotau police station, allegedly from the injuries he sustained.

The man’s father has called for an investigation into his son’s death.

Police say they are currently investigating the death of the young man and have invited his family to submit a formal complaint. There is an “investigation task force on the ground in Alotau that aggrieved persons or families can approach and register their complaints” and “all complaints will be investigated and acted upon”, police say.

Manning acknowledged there had been some issues with police behaviour in response to the gang’s actions.

“Yes, there have been discipline issues with some of our personnel and these matters have been dealt with though disciplinary procedures,” the police commissioner said. However, it was important to distinguish between fact and rumour spread by Baker’s supporters, he said.

“We have no intention to be light-handed as we deal with this situation, because the killings and looting by this gang must be stopped and where appropriate this requires a heavy hand from law enforcement agencies.”

In the immediate aftermath of the April gun battle, police arrested nearly 40 people, suspected of been gang members, for arson or for looting. Among the group were two women believed to be Baker’s aunts – one says she is not related to him – who were arrested on charges they allegedly harboured Baker.

Speaking to the Guardian in May through the fence of the women’s section of Giligili Correctional Service Institute, Laurinda Kauma, 57, and Agnes Miro, 67, maintain they haven’t seen Baker since he went on the run from police.

Miro said: “He usually lives in the bushes with his gang. We have never seen him since he started his criminal activities, nor do we know where he is hiding.”

Kauma and Miro have since been released on bail.

On the other side of the prison, in the men’s wing, stood men of all ages, scooped up by police in the wake of the violence between police and Baker’s gang. A 56-year-old man who was accused of arson during the violence was furious, claiming he was innocent.

“Look at me, I am a father, I have children and grandchildren,” he said. “Why would I go around burning down government properties?.

Police said that they could not comment on the arrests as some people had now been charged and their cases were before the courts.

‘They burnt my house down’

At the end of April, after the gun battle, half a dozen homes including Baker’s family home and the home of his ex-girlfriend were burnt down at Bottom Town following a police raid.

A member of Baker’s ex-girlfriend’s family said police went to her home and asked them where Baker was. “We didn’t know, we don’t know where he is. Our niece went out with him a long time ago, they are no longer together, but they told us to leave. They were fully armed. We were scared so we just left.

“We didn’t take anything, we ran out of the house and our home was burnt down. We don’t know where to go.”

Manning said Baker and his gang were “cunning criminals who take over the homes of people and try to stir confrontations with police, and they damage private property claiming this was done by police”. He did not answer questions about whether police burnt down the homes at Bottom Town or whether they believed that to be the work of Baker’s gang.

Donald Yamasombie, the deputy commissioner of police operations, said there were ways to resolve issues and Baker and his gang should turn themselves in and solve their issues through the proper channels.

“Do it for Milne Bay, for your people – surrender,” he said…. PACNEWS

  • For those who are fed up with going nowhere fast.
  • For individuals who’ve aimed high but seen little alteration in their lives.
  • For anyone drowning in the din and feeling their self-assurance slip away.

The honest truth is:

The 1% Rule is the book  I wish I had.

Because I’ve been where you’ve been —and needed a way out.

Tried Everything, and Felt Stuck

In a candid interview, the author of “The 1% Rule” shared insights into the journey of self-improvement and the challenges that come with it. His experiences resonate with many of us who have sought change through various means, only to find ourselves back where we started, minus the financial investment.

The Cycle of Effort and Stagnation

“I tried everything,” the author confessed, reflecting on his extensive efforts to grow through workshops and expert advice.

“Yet, despite the flood of motivation, I’d return home to unchanged circumstances, with only my finances taking a hit.”

This cycle of high hopes followed by disappointment led to a significant amount of self-doubt, a sentiment familiar to many in the pursuit of personal development.

The Revelation

The turning point came with the realization that crafting a vision was just the beginning.

“It might seem straightforward, but none of the programs or workshops showed me how to methodically work backwards from my goals,”

This lack of practical tools to bridge the gap between current realities and aspirations was a critical missing piece in his journey.

Developing a New Framework

Driven by his experiences, the author developed his own framework, detailed in “The 1% Rule.” “This framework is designed to empower you to regain control and reaffirm your belief in your capabilities, irrespective of past setbacks,” he explained. It’s a testament to his belief that with the right approach, overcoming stagnation is not just possible but inevitable.

A Universal Struggle

“Each time we set a goal and fail to progress, we chip away at our self-belief,”

the author noted, highlighting a universal struggle. Yet, he remains optimistic, “But that doesn’t have to be your story.”

His words serve as a reminder of the resilience within each of us, capable of overcoming disillusionment and disarray.

The 1% Rule

The author shared the core questions that drove his exploration: Why do some individuals achieve remarkable success effortlessly, while others remain stagnant? What distinguishes those who are perpetually motivated from those who burn out quickly?

A Multifaceted Approach

“Nothing was off limits,” the author stated, emphasizing his holistic approach to understanding success. From physical challenges to spiritual retreats and entrepreneurial ventures, he sought wisdom in diverse realms.

Breakthrough Realizations

The pivotal moment came when the author began to see the patterns and principles shared by those who consistently excel.

“Nothing separates you and me from those we admire at the top of the mountain—we’re one and the same,”

he revealed.

The difference lies in perception, clarity in goal-setting, and the habits cultivated to achieve success.

Debunking Myths and Embracing New Patterns

One of the most significant insights was the realization that common myths about success hold many back.

Letting go of these myths and adopting new behaviors and mindsets is crucial for powerful execution and becoming unstoppable.

The Genesis of “The 1% Rule”

These insights, forged over a decade of research and personal experiences, culminated in the creation of “The 1% Rule.”

The book is a response to the observation that many talented individuals fail to sustain momentum towards their goals, eventually reverting to old patterns and giving up on their dreams.

A Manifesto for Change

“This is your manifesto,”

the author declared, addressing readers seeking to bridge the gap between their current state and their aspirations.

The book aims to offer a new perspective, alleviate self-imposed pressure, and provide a system for lifelong achievement and fulfillment.

The 1% Rule Reviews

It’s been absolutely incredible to read the reviews about The 1% Rule, and I wanted to share some with you.

I am on a journey at the moment and am struggling to stay in track. This book helped me decide to take time out of my busy day this week and work on core outcomes, core processes and 1% processes. It inspired me to spend nearly two hours working on these things alone and I feel closer to bridging that gap between where I am at the moment and my original 6 month(now 4 month vision) because of it. Thank you Tommy Baker. – A Cahill
The best book I’ve read in a long time! The problem with most “self-help” books is that they contains a ton of great thoughts and theories without any actionable steps to take now. Not the case with this book. Tommy Baker does an excellent job at getting to the core of the problems, instilling motivation, and then giving action steps that can be taken right now to move forward and make progress. I highly recommend this book for anyone considering it. – Matt Olsen
This book delivers great tools both for personal development, business management and entrepreneurship. Very well written, focused and easy to understand, it is totally a “hands-on book” from the first chapter up to the last one. Don’t expect the ultra-fast get rich / get famous schemes. However, along the book there are many quick wins that, when used, will change your life immediately. – M Alcantara
Tommy Baker is my new favorite author and this is my new favorite book! I have implemented some of his suggestions (Pomodoro Technique), and see the difference in my daily routine already. I have no doubt that my business will look completely different in 90 Days. -Julie S

The series is a deep dive into the intricate and exhilarating world of biker lifestyle, exploring the multifaceted aspects and the inherent complexities of establishing a motorcycle club. For enthusiasts and curious minds alike, “American MC” is available for streaming on a plethora of platforms, including Crackle, The Roku Channel, Tubi TV, and Prime Video, allowing a wide audience to experience the thrill and the bonds formed on the open roads.

Tommy Baker, the vibrant and spirited leader of this diverse group of weekend bikers, is the heartbeat of “American MC.” He has spearheaded numerous rides, guiding his band through the varied and expansive landscapes of America. Tommy’s leadership is not just about exploring terrains; it’s about exploring the soul of the group, the individual spirits, and the shared bonds that form the core of “The Ice Cream Men From Hell”—a name conceived by Tommy to reflect the distinctive blend of characteristics of his group.

The name is not just a moniker; it’s a representation of the shared experiences, the adventures, and the camaraderie that define the group. It symbolizes the essence of their journeys, the collective spirit, and the ethos that bind them together. Tommy, inspired by the unity and the shared adventures, envisioned a unique patch, meticulously designed to be a tangible representation of their shared experiences and the bonds forged on the open roads.

With a discerning eye and a deep understanding of the values and the spirit of “The Ice Cream Men From Hell,” Tommy bestowed the ‘colors’—the emblematic patches—upon the riders he deemed worthy. These colors are not just patches; they are badges of honor, symbols of unity, and representations of the shared experiences and values of the group. Adorned with their colors, the riders continue their exploration of America, each journey adding a new chapter to their collective narrative, each adventure strengthening their bonds and enriching their shared experiences.

It’s a portrayal of the human spirit, of the pursuit of passion, and of the bonds that are formed when like-minded individuals come together.
