While no speed demon, this well-built cat makes for a capable world cruiser

First impressions

If you climbed the mast and viewed the Privilege 39 from that perspective its most distinctive feature becomes obvious, the large area of solid bridgedeck forward. Sure it adds a bit of weight but it also adds rigidity and strength. It provides secure deck space for working on the boat and for supporting the forward crossbar. It sets Privilege apart from other builders who just string a net between the hulls supported by an aluminum extrusion. When viewed in profile, the 39 hulls appear to be raised and the sleek, two-tiered cabintrunk flows naturally from the hull lines. In its day, it was modern catamaran styling. Today, it seems dated. The 39 has a 36-foot waterline and a 21-foot beam, which adds up to a lot of square footage. There is adequate bridgedeck clearance and the fine entries of the hull are known to have a good motion in a seaway. The shallow fixed keels translate into a draft of 3 feet, 6 inches. Overall displacement is just a whisker under 14,000 pounds. The mast height is just over 50 feet above the waterline and working sail area is approximately 850 square feet.

Construction

Each Privilege 39 was built on a semicustom basis. Unlike most cruising cats, the interior features hand-cut wooden bulkheads and furniture facings instead of molded liners. One of the reasons Privilege boats have been more expensive than their competitors is the company doesn't take advantage of scale production techniques. The boats are literally built the old-fashioned way, which is unique in the multihull universe. The interior joinerwork is excellent. The fiberglass sculpting is also excellent. The 39's hulls are composite, cored from the waterline up and solid from the waterline down. The deck is cored throughout, except in areas of high loading. The hull-and-deck joint incorporates the expansive bridgedeck on a flange. The forward crossbeam is heavy gauge aluminum and mounted on a universal joint that allows a bit of flex and movement in the hulls. The upward V-shaped striker helps carry the load for the forestay.

What to look for

The Privilege 39 is also called the Privilege 12, representing its metric length. It is also sometimes called the Alliaura 39, the name of the company that purchased Privilege in 1996. However, shortly after the company was sold, the new Marc Lombard-designed 395 went into production. Don't confuse the two models, the 395 is an extension of the Privilege 37 and sells for a lot more. Otherwise, they are all the same boat, which was in production from the late 1980s through the late 1990s. In general the Privilege 39 has held up very well. A 1989 model in Ft. Lauderdale that has been sailed hard and put away wet requires just a bit of love and elbow grease to be ready for sea. Be wary of former charter boats. The 39 has the four-cabin layout and many boats were in charter fleets. Former charter boats can sometimes represent terrific values but they can also require costly refits that can quickly defeat the advantages of a reduced selling price. Remember, if you need to re-power, you are talking about replacing two engines, which certainly adds up.

The Privilege 39 has a huge cockpit, even by catamaran standards. The T-shaped helm station is aft on the port side. It feels more like the helm of twin-wheel monohull and I prefer it to the bulkhead mounted wheels of most similarly sized cats. It is, however, often exposed to the both sun and spray. I like the way the sail controls are led to sailing stations on either side, freeing up the cockpit for socializing. The mainsheet traveler runs the length of the cockpit and is easily accessed from either side. The cockpit includes a lovely teak table and loads of storage. Indeed, that's a Privilege trademark, lots and lots of storage, both on deck and below. Teak seats aft seem positively elegant in this age of molded fiberglass madness. Most boats will be fitted with davits that allow a good-sized dinghy to be slung between the hulls. Most boats will also have an array of solar panels mounted above the davits. Unlike some cats, the bimini top may or may not cover the entire cockpit. The swim steps seem a little small and difficult to access, especially by today's standards. In general, Privileges have heavier rigging than most catamarans, again emphasizing their commitment to offshore sailing. The mast is supported with uppers and lowers, which is unusual and welcome, and the staysail stay's chainplate is well supported in the solid forward section of the bridgedeck. Most 39s are set up as cutters, with the staysail furling as well as the lighter headsail. Some boats are rigged to fly screechers, otherwise known as drifters. Small items like hefty pulpits and well-supported stanchions also set the Privilege 39 apart. The two small triangular areas of net forward provide a nice spot for sunbathing and watching dolphins gambol between the hulls. The anchoring arrangement includes a husky stemhead fitting and Bruce anchor roller. The chain locker is in the bridgedeck, and unlike cats without a solid forward section, the ground tackle does not need to be led a long way aft. From well-placed teak handrails to aggressive nonskid to lower shrouds to grasp, the Privilege 39 is friendly on deck, even in a seaway. Down below

The Privilege 39 has a surprisingly handsome interior set off by plenty of cherry or mahogany woodwork. Even the expansive portlights are nicely framed in wood. The 39 has a warmth about it that I like. The layout on other hand is not my favorite. Access to the saloon is through wooden doors from the port side of the cockpit. A large aft opening port and all around forward ports makes the saloon light and airy. A large U-shaped settee draped around a table dominates the saloon. A forward facing nav station is to starboard. This is a nice spot to sit while underway. The forward and side visibility is more than adequate and you are out of the weather. The galley is down, meaning that it's stashed into the port hull. While models differ, most include a single sink, 12-volt refrigeration opposite, a two- or three-burner non-gimballing stove and again, ample storage in well-placed bins and lockers. Each hull features two double cabins. The forward cabins in each hull include athwartship bunks, which makes good sense and is yet another advantage of the large bridgedeck. This arrangement allows for large locker space and forward facing portlights. You can lie in your bunk and see if the anchor is dragging. Heads are located in the walkway of each hull and the aft bunks are also situated athwarthships. Overall ventilation is excellent provided by numerous deck hatches and opening portlights.

The original engines were 29-horsepower Volvo diesels with saildrive transmissions. Access is through the lazarettes on the aft end of each hull. Several of the boats on the market have re-powered with Yanmar diesels. Either set of engines have enough oomph for the Privilege 39 to motor at 8 knots and still maintain decent fuel economy. The total fuel capacity is 400 liters, translating into just over 100 U.S. gallons.

Several Privilege 39s have circumnavigated and many others have crossed oceans. In fact, almost every 39 available for sale on our side of the world will have crossed the Atlantic on its own bottom. That speaks volumes about the boat's seakindliness. How does it perform in the more pedestrian world of daysailing or knocking around the coast for weekend? Just fine, but it's not as lively as monohull sailors might think. The Privilege 39 is not a lightweight cat, and it's not overflowing with sail area. It will attain double digits while reaching in tradewind conditions but only 7 or 8 knots upwind. And that is nothing to be ashamed of. The motion is not as rapid as on some faster cats and that's a positive.

I like the concept and the execution of the Privilege 39. It's a genuine cruising cat, capable of fast passages and not daunted by heavy weather. If I were in the market for a catamaran to take my family on a circumnavigation, I would begin my search by zeroing in on the Privilege 39.

The origins of the Privilege shipyard: the foundation of a symbol of maritime excellence

The Privilege shipyard was created in 1985 by Philippe Jeantot, a renowned professional sailor and two-time world champion in solo racing. Moreover, Mr. Jeantot is also the founder of the famous Vendée Globe sailing race.

Indeed, the history of the shipyard begins with his idea to design a cruising catamaran for his family.

The development of the Privilege brand

Privilège became the European leader in the production of cruising catamarans in 1989. Even more, it conquers the American market.

As a result, the shipyard is honored with several awards, including the International Quality Trophy in 1992 and the election of the Privilege 45 and 42 as the boat of the year in the United States in 1995 and 1996.

In 1996, thanks to Alliaura Marine, the Privilège range consolidated its position at the top end of the market by developing a range of boats over 15 meters, the flagship of which is the Privilège 745. At that time, the brand had already delivered more than 60 units from 18 to 23 meters to owners around the world.

From Privilege to Privilege Marine: successful integration into the HanseYachts group

Privilège became Privilège Marine in 2012, after being acquired by the company Vendéenne de Capital Investissement (VCI), headed by Gilles Wagner. This name change marked a new era for the brand, with a new visual identity and a renewed commercial strategy focused on emotion, quality and experience. In 2017, Privilege Marine became part of the HanseYachts group , which also owns Sealine , Moody,  Dehler , Feeling and  Fjord.

Privilege catamarans: the reference in luxury and performance

Today, Privilege Marine offers a range of cruising catamarans from 50 to 80 feet:

There are several models of used Privilege boats that are famous and sought after by enthusiasts. Here are some examples:

  • Privilege 745: This flagship of the Privilege range is a 23-meter long luxury catamaran. It is equipped with all modern comforts and offers an incredibly spacious living area.
  • Privilege 585: This high-end cruising catamaran is 17.5 meters long and is also very popular on the second-hand market. It offers exceptional comfort and safety for long crossings.
  • Privilege 465: This smaller model is 14 meters long and is ideal for cruising with family or friends. It is easy to maneuver and offers all the comfort necessary for long sailings.

Privilege Catamarans

Privilege Marine was founded by Rene Bernard, and the world-famous offshore sailboat racer, Phillippe Jeantot. Jeantot was considered at the time one of the best single-handed offshore sailors, and ultimately went on to start the Vendee Globe Round the World Race. The original concept for Privilege Marine was to build a blue water cruising catamaran for a family circumnavigation.

The company opened up the Jeantot Ship Yards in the heart of Les Sables d’Olonne on the infamous Bay of Biscayne. The first catamaran to come out of the shipyard was the Privilege 39, which is now considered one of the most iconic catamarans to come out of the 1980’s.

In the late 1980’s, Privilege began a 30+ year relationship with designer Marc Lombard, who to this day still designs catamarans for Privilege Marine. Some of his most famous designs include the Privilege 585 catamaran, made famous by the YouTube Channel, Sailing Zatara, and the Privilege 615, one of the first catamarans to be built with a fly bridge.

To own a Privilege Catamaran is like owning a classic Rolls Royce. They are elegant and rugged, cutting-edge designs and timeless. Each Privilege catamaran is a semi-custom build and as a result, no two Privilege catamarans are the same.

The boat had a mini-refit this past fall 2022 including all new Raymarine navigation instruments and 12" plotter, new radar, new Raymarine autopilot, new Echo-Tech watermaker, new Lewmar windlass, new enclosure, new mattresses and soft goods. The bottom was painted and running gear serviced.

This is thesought-after owner version with a large king-size bed inthe forward"beam-to-beam" cabinand two guest cabins aft.The galley is up and includes four burner stove, double sink, dishwasher and Corian counter tops. The interioris fitted in a cherry wood veneer that is finished to a high gloss. The yacht has seen limited use and registers just 1800 hours on the twin 75 HP Volvo engines. Allcomfort amenitiesare aboard: large 12KW generator generator (1500 hours), full air conditioning (4 x 16,000 BTU compressors), water-maker, fridge and separate freezer and a washing machine.

Thesail wardrobefeatures durableIncidences Hydranet mainsail and genoa, screecher on separate removeable stay and 2 Parasailors for efficiency and ease of use on long downwind passages. Electric primaries, main halyard/reef and main sail sheet/traveler winches (5 electric winches), allow theowner to run the boatshorthanded with his wife. The hard-top bimini facilitates mainsail accessand handling.

The powerful aluminum Marechal mast is stayed by an upper cap and lower shroud on each side and by a forestay and inner stay (baby-stay) forward. The raised stanchions are higher than the standard allowing for a third row of lifelines. This tough, uncompromising yacht will take your family in complete safety and comfort through the Caribbean or on a circumnavigation.

The dedication to luxury and practical comfort is unequalled on a Privilege cat. The joinery and finish inside are matched only by the caliber and quality of the stainless fittings on deck. The salon and cabins are roomy and light; the cockpit is large and offers easy access to very wide transoms.

Republicans vote to hold Garland in contempt of Congress. Here’s what that means

WASHINGTON (AP) — Merrick Garland became the third attorney general in U.S. history to be held in contempt of Congress Wednesday as Republicans moved to punish the Justice Department for refusing to turn over audio related to President Joe Biden’s handling of classified documents .

Contempt is one of U.S. lawmakers’ politically messiest and, until recent years, least-used powers. It is a tool that the House and the Senate can employ either to coerce compliance with a subpoena or to remove any obstruction from an ongoing investigation.

By approving a contempt resolution, the House effectively recommended that Garland be prosecuted. And recent cases against allies of former President Donald Trump including Steve Bannon and Peter Navarro have proved that a contempt resolution is far from symbolic, creating the basis for a case that can sometimes hold up in court.

Here’s what to know about the contempt fight with Garland and the turmoil ahead.

Why are Republicans pushing to hold Attorney General Merrick Garland in contempt?

Successfully holding Garland in contempt is just the latest broadside by Republicans against the Justice Department.

GOP lawmakers — led by Reps. Jim Jordan and James Comer — decided to move ahead with holding Garland in contempt for refusing to fully comply with a congressional subpoena issued as part of their probe into special counsel Robert Hur’s decision not to charge the Democratic president with any crimes. Hur investigated Biden’s handling of classified documents.

The House Judiciary and Oversight & Accountability committees’ chairmen had ordered the Justice Department to turn over audio of Hur’s interviews with Biden by early April. But officials provided only some of the records, leaving out the audio of the Biden interview and warning of the precedent that would be set for future investigations if the audio was provided.

On the last day to comply with the subpoena, the White House blocked the release of the audio by invoking executive privilege. It said Republicans in Congress only wanted the recordings “to chop them up” and use them for political purposes.

Executive privilege gives presidents the right to keep information from the courts, Congress and the public to protect the confidentiality of their decision-making, though it can be challenged in court.

Garland has defended the Justice Department, saying it has gone to extraordinary lengths to provide information to lawmakers.

“There have been a series of unprecedented and frankly unfounded attacks on the Justice Department,” Garland said in a press conference last month. “This request, this effort to use contempt as a method of obtaining our sensitive law enforcement files, is just most recent.”

What is contempt of Congress?

Contempt of Congress is an enforcement mechanism for lawmakers that is enshrined in the legal code.

Under U.S. law, it is considered a misdemeanor criminal offense to willfully fail to comply with a valid congressional subpoena for producing documents or testimony, according to a report from the nonpartisan Congressional Research Service.

But what amounts to contempt of Congress is often in dispute, which means that a contempt vote by the House or the Senate is only the beginning of a potential legal process. It is up to prosecutors to turn a contempt resolution into a case, and it is up to a jury to decide whether a person is guilty of a crime. Some contempt resolutions are never acted upon.

What is the process for holding someone in contempt?

Contempt usually begins with the introduction of a resolution in the committee of jurisdiction. In the case of Garland, the House Judiciary and Oversight & Accountability committees advanced dual contempt reports out of the committees in back-to-back party line votes.

The next step would be for the full House of Representatives to adopt the report through a majority vote, similar to how the chamber did on Wednesday in a 216-207 vote. The referral is then sent to the Justice Department. The Senate does not have to approve the resolution, as each chamber of Congress has its own enforcement power.

The last time an attorney general was held in contempt was in 2019. That was when the Democratically controlled House voted to make then-Attorney General Bill Barr the second sitting Cabinet member to be held in contempt of Congress for refusing to turn over documents related to a special counsel investigation into Trump, a Republican.

Years before that, during the administration of President Barack Obama, a Democrat, then-Attorney General Eric Holder was held in contempt related to the gun-running operation known as Operation Fast and Furious .

In each of those instances, the Justice Department took no action against the attorney general.

Administrations of both major political parties have long held the position that officials who assert a president’s claim of executive privilege can’t be prosecuted for contempt of Congress, a Justice Department official told Republicans last month.

Assistant Attorney General Carlos Felipe Uriarte cited a committee’s decision in 2008 to back down from a contempt effort after President George W. Bush, a Republican, asserted executive privilege to keep Congress from getting records involving Vice President Dick Cheney.

What are the penalties for being held in contempt?

Contempt votes have become more frequent in recent years, with serious repercussions for the defendants.

If the Justice Department decides to take up the contempt resolution and pursue a case, violations can be punishable by a fine of up $100,000 and imprisonment “for not less than one month nor more than twelve months,” according to the CRS.

Bannon, a longtime ally and aide of Trump, was held in contempt of Congress in 2021 for refusing to comply with a subpoena from the House Jan. 6 committee and was convicted by a jury in the summer of 2022. Bannon was recently ordered to report to prison by July 1 to serve a four-month sentence.

Navarro , a Trump trade adviser, was also convicted of contempt of Congress after defying the Jan. 6 panel. He reported to prison in March to serve his four-month sentence .

Even for those who escape prosecution, a contempt of Congress resolution remains a mark on their record.
